Radar

The RADAR (Record and Tracking of Customs Intervenor Performance), is the license to operate in foreign trade, i.e., to use the Siscomex, the license consists of a previous exam of the ones who intend to carry out import and/or export operations.

Before starting its foreign trade operations, the legal entity or natural person must go to an IRS unit to get its license.

The legislation that sets forth the license to importers and exporters is regulated by the Normative Ruling RFB no 1288, of August 31 of 2012 and by the Coana Executive Declaratory Act no 33, of September 28 of 2012.

Basically, there are 3 modalities: express, limited and unlimited. They vary according to the intervenor’s operation and type, as it is summarized below:

1. Express: for the legal entity incorporated in the form of a publicly traded company, with shares traded on stock exchanges or over the counter and its wholly owned subsidiaries; legal person authorized to use the Express Customs Clearance (Blue Line), in terms of SRF no 476/04; public or mixed company, public administration, legal person, qualified to enjoy the tax benefits provided for by Law no. 12.350/10, and legal entity that intends to act exclusively on export transactions usually act in foreign trade.

2. Limited: the limited modality is intended to companies whose financial capacity to carry out foreign trade operations (in a 6 months period) is equal or lower than USD 150.000,00.

3. Unlimited: the unlimited modality is intended to companies whose financial capacity to carry out foreign trade operations (in a 6 month period) is higher than USD 150.000,00.

NOTE: The choice of license modality most suitable to each company is free and of its full responsibility.
